Welcome to remaxocean.net (hereinafter, the “Site”). These Terms and Conditions govern the use of the Site, services, applications, content, and any digital interface operated by RE/MAX Ocean, an entity with offices located in Downtown, Punta Cana, Dominican Republic (hereinafter “RE/MAX Ocean,” “we,” “us,” or “the Real Estate Agency”). By accessing or using the Site, you (“User”) agree to be bound by these Terms and Conditions, as well as our Privacy Policy (which forms an integral part of this agreement).

1. Acceptance of the Terms and Conditions

1.1

By accessing, browsing, using, or registering on the Site, you expressly and unconditionally agree to these Terms and Conditions. If you do not agree with them, you must not access or use the Site.

1.2

RE/MAX Ocean reserves the right to modify these Terms and Conditions at any time. Any changes will become effective upon publication on the Site, with the date of the latest version clearly indicated. You agree to review this section periodically to stay informed of any changes. Continued use of the Site after changes are published constitutes acceptance of those changes.

2. Users

2.1 General Users

A User is any natural or legal person who accesses the Site, whether by registering or simply browsing, for the purpose of searching for real estate, contacting agents, using financing tools, publishing properties (if applicable), or using any service offered by the Real Estate Agency.

The User represents and warrants that:

  • They have the legal capacity to enter into binding obligations (legal age or legal representative of an entity) in accordance with Dominican law.

  • They act in good faith, for lawful purposes, and will not engage in activities contrary to the law, public order, or morals.

  • They are responsible for all information provided and ensure it is accurate, truthful, and up to date.

2.2 Registered Users

When a User completes an online registration, they become a Registered User. To do so:

  • Mandatory fields must be completed with truthful information.

  • The User is responsible for the use of their account, username, password, and all activity conducted under it.

  • The account may not be transferred or assigned.

  • Any unauthorized use of the account must be reported immediately so appropriate measures can be taken.

  • Creating multiple accounts without authorization is strictly prohibited.

RE/MAX Ocean may request additional information (identification documents, proof of identity) to verify a Registered User’s identity. Failure to cooperate may result in suspension or cancellation of the account.

3. Services and Transactions

3.1

The Site operates as an intermediary and information platform, allowing the publication, search, and contact between users interested in real estate, real estate agents, buyers, sellers, tenants, and landlords. RE/MAX Ocean is not a party to transactions (purchase, sale, or lease) between Users, except where separate agreements are formally executed.

3.2

Offers, prices, property descriptions, financing conditions, and other terms are the sole responsibility of the Users who publish them (sellers, landlords, or agents).

3.3

RE/MAX Ocean does not guarantee the accuracy, legality, physical condition, registration status, or tax compliance of the listed properties. Nor is it responsible for third-party breaches or negotiations conducted outside the Site.

3.4

Any contract, agreement, promise, or transaction between Users shall be executed directly between them, without obligation for RE/MAX Ocean to participate or intervene, unless expressly agreed otherwise.

4. Warranties and Limitation of Liability

4.1

The Site and services are provided “as is” and “as available.” RE/MAX Ocean makes no warranties regarding uninterrupted access, continuity, error-free operation, compatibility with user equipment, or that the services will meet User expectations.

4.2

Under no circumstances shall RE/MAX Ocean be liable for indirect damages, loss of profits, loss of data, operational losses, or any other damages arising from the use of the Site, interactions with other Users, access or inability to access the Site, or reliance on the platform.

4.3

We do not guarantee that the Site will be free from technical errors, interruptions, failures, or interference caused by third parties, force majeure, or circumstances beyond our control.

4.4

You grant RE/MAX Ocean an irrevocable, worldwide, royalty-free license to use, reproduce, modify, and publish any content you provide on the Site (photos, descriptions, documents) for the purpose of promoting the platform, with attribution to the User, in accordance with these Terms.

5. Suspension, Account Termination, and Content Removal

5.1

RE/MAX Ocean may suspend, limit, or terminate a User account or remove content without prior notice if:

  • The User violates these Terms or applicable law.

  • The platform is used for illegal or abusive activities.

  • A unilateral decision is made due to reputational or technical risk.

5.2

In the event of suspension or termination, the User shall not be entitled to any compensation for lost operations or information.

6. Privacy and Data Protection

6.1

The collection, use, storage, and protection of personal data are governed by our Privacy Policy, which forms an integral part of these Terms.

6.2

In compliance with Dominican Law No. 126-02 on Electronic Commerce, Documents, and Digital Signatures, and other applicable regulations, any digital data or document shall be considered valid if it meets legal requirements, unless otherwise provided by law.

6.3

If these Terms constitute a contract of adhesion, as defined by the General Law for the Protection of Consumer and User Rights No. 358-05, they must be drafted in clear, legible Spanish and expressly accepted. Such contracts must be filed with Pro Consumidor when required by law.

6.4

RE/MAX Ocean does not request sensitive data, and the User agrees not to provide such data improperly.

7. Intellectual Property

7.1

All Site content (texts, images, logos, design, software, trademarks, trade names) is the property of RE/MAX Ocean or authorized third parties and is protected by Dominican law and international intellectual property treaties.

7.2

Users may not reproduce, distribute, modify, adapt, publicly display, create derivative works from, or commercially exploit such content without prior written authorization from RE/MAX Ocean.

8. Content Use and User Obligations

8.1

Users are responsible for ensuring that any content they publish does not infringe third-party rights (property, privacy, copyright, trademarks, etc.).

8.2

Copying or extracting Site databases, scraping content, or using automated data extraction methods without authorization is strictly prohibited.

8.3

The User agrees to indemnify and hold RE/MAX Ocean harmless from any claim, demand, penalty, fine, or expense arising from the content they publish or improper use of the Site.

9. Disputes Between Users

Any dispute, claim, or conflict between Users arising from use of the Site (sales, leases, payments, breaches, etc.) shall be resolved directly between the parties involved. RE/MAX Ocean shall be exempt from any liability related to such disputes.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Dominican Republic. Any dispute arising from this agreement shall be submitted to the competent ordinary courts of the National District or the jurisdiction applicable under Dominican law.

11. Indemnification

The User agrees to defend, indemnify, and hold harmless RE/MAX Ocean, its affiliates, directors, employees, and collaborators from any claim, liability, damage, fine, or expense (including legal fees) arising from a breach of these Terms or from the User’s actions or omissions in using the Site.

12. General Provisions

12.1

This agreement does not create any agency, partnership, joint venture, or employment relationship between RE/MAX Ocean and the User.

12.2

The assignment of rights or obligations by the User without prior written authorization from RE/MAX Ocean is prohibited. RE/MAX Ocean may assign its rights or obligations, in whole or in part, to third parties, including affiliates.

12.3

If any provision of these Terms is deemed null, invalid, or unenforceable, such provision shall be removed or adjusted to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12.4

Failure by RE/MAX Ocean to enforce any right under these Terms at any given time shall not constitute a waiver of such right in the future.

12.5

The parties acknowledge that these Terms constitute the entire agreement between them regarding the subject matter herein and supersede any prior verbal or written understandings.
